These Terms and Conditions ("Terms") govern your use of the Violeta Goods website
located at www.violetagoods.com.au ("Website") and your purchase of products from us.
By accessing the Website or placing an order, you agree to be bound by these Terms. If
you do not agree to these Terms, please do not use the Website.
Violeta Goods ("we", "us", "our") is an Australian-registered business operating under the laws of the Commonwealth of Australia and the relevant State and Territory legislation.

1. Acceptance of Terms
By browsing, accessing, or using this Website, or by placing an order through this Website, you confirm that:
- You are at least 18 years of age or are accessing the Website under the
supervision of a parent or legal guardian;
- You have read, understood, and agree to be bound by these Terms; and
- You have read and accept our Privacy Policy, which is incorporated into these
Terms by reference.
We reserve the right to update these Terms at any time without prior notice. The version published on the Website at the time of your order shall apply to that transaction.

2. Products & Descriptions
Violeta Goods sells premium leather travel accessories including, but not limited to, laptop cases, passport cases, card holders, and mirror cards. All products are subject to availability.
We endeavour to ensure product descriptions, images, and specifications are accurate;
however, we do not warrant that product descriptions or other content on the Website are error-free, complete, or current. Colours displayed may vary slightly due to screen
calibration differences. Minor variations in leather texture and colour are inherent to
genuine leather and are not considered defects.
We reserve the right to limit quantities, discontinue products, or amend product listings
without notice.

3. Pricing & Currency
All prices displayed on the Website are in Australian Dollars (AUD) unless you have
selected an alternative currency at checkout. Prices are inclusive of applicable Australian Goods and Services Tax (GST) where required by law.
Where prices are displayed in a currency other than AUD, these are indicative estimates based on current exchange rates and may differ from the final amount charged by your bank or payment provider. The final transaction amount will be determined by your payment provider at the time of processing.
We reserve the right to change prices at any time without notice. Price changes will not
affect orders already confirmed by us.

4. Orders & Contract Formation
4.1 Placing an Order
When you submit an order through the Website, you are making an offer to purchase the selected products on these Terms. All orders are subject to availability and acceptance by us.

4.2 Order Confirmation
An automated order confirmation email does not constitute acceptance of your order. A binding contract is formed only when we dispatch the goods and send you a shipping confirmation email.

4.3 Order Cancellation by Us
We reserve the right to refuse or cancel any order at our discretion, including where:
- A product is out of stock or discontinued;
- There has been an error in the product listing or pricing;
- We suspect fraudulent, unauthorised, or unlawful activity; or
- We are unable to fulfil the order for any operational reason.
In such circumstances, we will notify you promptly and issue a full refund of any payment received.

5. Payment
We accept payment via the methods displayed at checkout, which may include credit card, debit card, and other digital payment options facilitated through our Shopify-powered platform and third-party payment processors.
By providing payment information, you represent and warrant that: (a) you are authorised to use the payment method; (b) the payment information is accurate; and (c) you will pay all charges incurred.
We do not store full payment card details on our systems. All payment processing is
handled by PCI-DSS compliant third-party providers.

6. Shipping & Delivery
6.1 Dispatch
We aim to dispatch orders within 2–5 business days of payment confirmation. Dispatch
times are estimates only and are not guaranteed.
6.2 Delivery Timeframes
Estimated delivery timeframes are provided at checkout and are based on information
supplied by our third-party carriers. We are not responsible for delays caused by carriers, customs, or circumstances beyond our reasonable control.
6.3 International Shipments
For international orders, the recipient may be subject to import duties, taxes, and customs fees imposed by the destination country. These charges are the sole responsibility of the recipient and are not included in the product price or shipping fee. We recommend checking with your local customs office before placing an order.
6.4 Risk of Loss
Title to and risk of loss for products passes to you upon delivery to the address specified at checkout.
6.5 Incorrect Addresses
We are not responsible for non-delivery or loss caused by an incorrect or incomplete
delivery address provided by you. Additional shipping charges may apply to re-dispatch orders returned due to address errors.

7. Returns, Exchanges & Refunds
7.1 Australian Consumer Law
Nothing in these Terms limits or excludes any rights or remedies you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) (“ACL”). Under the ACL, our products come with guarantees that cannot be excluded, including that goods will be of acceptable quality, fit for purpose, and match any description provided.
If a product fails to meet a consumer guarantee, you are entitled to a remedy from us. For a major failure, you may choose a refund, replacement, or compensation for the reduction in value. For a minor failure, we may repair or replace the product or provide a partial refund.

7.2 Change of Mind
We do not offer returns or refunds for change of mind. Please review your order carefully before completing your purchase.

7.3 Faulty or Incorrect Items
If you receive a faulty, damaged, or incorrect item, please contact us at
info@violetagoods.com.au within 14 days of delivery with:
- Your order number;
- A description of the issue; and
- Clear photographs of the item and packaging.
We will review your claim and, if valid, arrange for a replacement, repair, or refund at our discretion, consistent with your rights under the ACL.

7.4 Return Condition
Where a return is approved, items must be returned in their original condition, unused, and in original packaging. We reserve the right to refuse a return if these conditions are not met.
Return shipping costs are your responsibility unless the return is due to our error or a
product fault covered under the ACL.

8. Intellectual Property
All content on the Website, including but not limited to text, graphics, logos, images,
product designs, and photography, is the property of Violeta Goods or its licensors and is protected by applicable intellectual property laws.
You may not reproduce, copy, distribute, transmit, display, or otherwise exploit any content
from the Website without our express prior written consent.

9. Prohibited Use
You agree not to use the Website to:
- Engage in unlawful, fraudulent, or harmful conduct;
- Transmit unsolicited commercial communications (spam);
- Introduce malware, viruses, or other harmful code;

We exclude all liability for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, even if we have been advised of the possibility of such damages.
Nothing in these Terms excludes or limits our liability for fraud, wilful misconduct, or any liability that cannot be excluded by law.

12. Disclaimer of Warranties
Subject to the ACL, the Website and all content are provided on an “as is” and “as
available” basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Website will be uninterrupted, error-free, or free of viruses.

13. Force Majeure
We will not be liable for any failure or delay in performing our obligations where such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to natural disasters, pandemic, industrial action, government restrictions, carrier failures, or interruptions to internet services.

14. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of New South Wales, Australia, and the laws of the Commonwealth of Australia applicable therein.
You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales and the Federal courts of Australia for the resolution of any dispute arising under or in
connection with these Terms.

15. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that
provision shall be severed from the remaining Terms, which shall continue in full force and effect.

16. Entire Agreement
These Terms, together with our Privacy Policy and any other policies published on the
Website, constitute the entire agreement between you and Violeta Goods with respect to your use of the Website and purchases made through it, and supersede all prior
communications and representations.
